Though not common and popular like the random drug testing and pre employment drug testing but the financial upshot, encountered by the businesses if not testing employees after the accidents on the sites make this method rather popular among different companies. It should not misinterpreted as an excuse to make the employee to lose his or her job, but relatively to guard the company from legal charge in the event that the individual is under the influence at the time of the accident. Such drug test acts as the protection to the property of the company from paying for some misapprehensions which can happen as a result of such an accident and it is nothing more and nothing less.

The company should not hold responsible for any kind of grievance sustained by the employee if any significant amount of drugs or alcohol are detected through drug testing. In most areas, it has been found that blood testing is the only legally justifiable means for identifying drug use after an incident, even though saliva testing is gaining approval because it gives the accurate result. It should be noted the sample collected for the drug testing should always be sent to a lab. It is also important for the employer to look into the matter seriously because it is the matter of company’s reputation as well as the employee’s life and career. So care should be taken that the even if the on-site tests gives the positive result decision should not be taken based on that result instead it should be followed up with a laboratory test before any action is taken against the employee. These kinds of responses are expected from good employers who give equal importance to their company’s reputation and the life of the employee.

The argument in the court can only reasonably be made if the blood or oral fluid / saliva testing displays positive result and obviously the decision will be taken on behalf of the company. Although there are methods of drug testing like urine, hair or sweat based testing but they are not popular in this type of case as they only detect past drug use. Whatever the test may be the goal of these drug tests is to detect the presence of drugs in the sample collected of the employee after the accident and all the decision taken is based on the facts of each case accordingly and this may be on behalf of the company to help the company avoid any kind of litigation completely or it may do nothing to help their case and decision goes on behalf of the employee.

There are some places where decision is instantly taken on, on-sites drug test result but in most states as well as in most non-U.S. countries laboratory tests (urine or blood) are the only legally recognized tests. Therefore it could be concluded that whatever sample is collected for drug test it should be tested in a laboratory so as to get the actual result followed up with good decision.
